Getting permission to build
In NSW, there are several routes to gaining permission to build, ranging from CDC (complying development certificate) to a Development Application ( DA). Each have a complex series of rules, some of which are hard and firm, such as in the case of a CDC and some of which have a degree of flexibility, where, if you have the knowledge and skills, it is possible to develop a scheme which doesn’t comply with the regulations, but which will still be acceptable to planners. CDC This gives you the most certainty and fastest approvals, if your home can fit within the strict rules this route prescribes.
- DA that meets all the rules and guidelines that apply to the site. This should be the fastest way to gain a DA from local council, but is still subject to uncontrollable time factors as council processes the application and even the best councils can take longer than expected.
- DA with variations from the various statutes and local plans. Contrary to popular belief, it is possible to breach many of the planning regulations and guidelines, so long as you are able to show that the outcome is no worse, or better than a complying scheme. This route is slow and tortuous but often leads to outstanding outcomes otherwise prohibited by strict adherence to the rules. This needs knowledge and experience and to date, SEED has a 100% record of getting approvals to build.
